A1 Certificate & EU Posting of Workers Consulting
B2B Expertise in International Posting
Posting staff to European Union member states involves a series of legal and financial risks if not prepared properly. XBT Trading provides specialised assistance to companies in a wide range of sectors (construction, transport, IT services, agriculture) that want to expand their activity or carry out commercial contracts beyond Romania's borders — and supports foreign companies engaging Romanian workers or subcontractors.
Our main consulting areas:
1. Audit and Preparation of Internal Documents
We verify the compliance of individual employment contracts and posting addenda against European Directive 96/71/EC and the national laws of the host country (e.g. payment of the applicable minimum wage in that state, posting allowances, working and rest time).
2. Company Eligibility Assessment (CNPP criteria)
Before filing the A1 application with CNPP, we analyse the structure of the company's turnover, staff and commercial contracts to determine the likelihood of approval. If there are risks or gaps, we guide you step by step in addressing them.
3. Registering and Declaring the Activity in the Host Country
Each EU member state has its own rules on the prior notification of posted workers (for example, the SIPSI portal in France, Meldeportal in Germany, LIMOSA in Belgium). Our team handles the correct and complete submission of these notifications to prevent work being stopped on site.
4. Taxation and Social Security Consulting
We help you understand the rules on employees' tax residence, payroll taxation and the payment of social contributions, making sure you remain covered by the Romanian system throughout the maximum permitted posting period of 24 months.
Why is posting without prior consulting risky?
Beware of inspections! Labour inspectorates in Western Europe have intensified checks against shell companies. The lack of a solid activity history in Romania, or an incorrectly prepared posting file, can lead to the rejection of the A1 certificate and the retroactive payment of social contributions in the country where the work is performed (at much higher rates, e.g. 35-45% of the salary).
Assistance in setting up branches / subsidiaries in the EU
For companies with long-term projects or recurring contracts, temporary posting may no longer be the optimal legal solution. We provide strategic consulting on:
- Identifying the point at which a posting becomes a permanent transfer of activity (permanent establishment risk).
- Advice on opening a new company or a subsidiary/branch in the destination member state.
- Coordinating local administrative procedures through our network of legal and accounting partners across the European Union.
Planning an expansion or a contract in the EU?
Avoid costly bureaucratic mistakes. A simple initial discussion with the XBT Trading specialists can save your company from heavy fines and legal complications.
